    FBR reinstates 10 customs officials into service on FST order

    ISLAMABAD: Federal Board of Revenue (FBR) has re-instated 10 customs officials into service in compliance to order passed by Federal Service Tribunal (FST), Lahore.

    The FBR issued notifications on Thursday to re-instate the officials in pursuance of judgment passed by FST, Lahore on July 11, 2019.

    Following are the notifications:

    01.No. 2072-C-III/2019:- In pursuance of judgment dated 11.07.2019 passed by Federal Service Tribunal, Lahore in Appeal No.508(L)CS/2017, Zahid Raza Bukhari, Ex-Superintendent, Directorate of Intelligence & Investigation-Customs, Faisalabadwho was removed from service on 08.05.2017 and subsequently converted into compulsory retirement vide FBR’s Notification No.2513-C-III/2017 dated 11.09.2017, is hereby re-instated into service with effect from 08.05.2017 i.e. the date of his removal from service. The intervening period from 08.05.2017 to 21.03.2018 during which he remained out of service is treated as period spent on duty.2. He retired from service on 21.03.2018 (A.N.) on attaining the age of superannuation.

    02.No. 2070-C-III/2019:-In pursuance of judgment dated 11.07.2019 passed by Federal Service Tribunal, Lahore in Appeal No.510(L)CS/2017, Mansoor Alam, Ex-Inspector, Model Customs Collectorate, Faisalabad who was compulsorily retired from service vide FBR’s Notification No.1414-C-III/2017 dated 08.05.2017, is hereby re-instated into service with effect from 08.05.2017 i.e. the date of his Compulsory Retirement. The matter of back benefits for the intervening period from 08.05.2017 todate during which he remained out of service, shall depend upon final outcome of denovo proceedings to be initiated against him in due course of time in the light of FST judgment.

    03.No. 2071-C-III/2019:-In pursuance of judgment dated 11.07.2019 passed by Federal Service Tribunal, Lahore in Appeal No.511(L)CS/2017, Amjad Iqbal Cheema, Ex-Inspector, Model Customs Collectorate, Faisalabad who was compulsorily retired from service vide FBR’s Notification No.1413-C-III/2017 dated 08.05.2017, is hereby re-instated into service with effect from 08.05.2017 i.e. the date of his Compulsory Retirement. The matter of back benefits for the intervening period from 08.05.2017 to date during which he remained out of service, shall depend upon final outcome of denovo proceedings to be initiated against him in due course of time in the light of FST judgment.

    04. No. 2069-C-III/2019:-In pursuance of judgment dated 11.07.2019 passed by Federal Service Tribunal, Lahore in Appeal No.509(L)CS/2017, Muhammad Ramzan, Ex-Inspector, Directorate of Intelligence & Investigation-Customs, Faisalabad who was removed from service on 08.05.2017 and subsequently converted into compulsory retirement vide FBR’s Notification No.2516-C-III/2017 dated 11.09.2017, is hereby re-instated into service with effect from 08.05.2017 i.e. the date of his removal from service. The matter of back benefits for the intervening period from 08.05.2017 to date during which he remained out of service, shall depend upon final outcome of denovo proceedings to be initiated against him in due course of time in the light of FST judgment

No. 2068-C-III/2019:-In pursuance of judgment dated 11.07.2019 passed by Federal Service Tribunal, Lahore in Appeal No.507(L)CS/2017, Ali Zahid, Ex-Inspector, Model Customs Collectorate, Faisalabad who was removed from service on 08.05.2017 and subsequently converted into compulsory retirement vide FBR’s Notification No.2515-C-III/2017 dated 11.09.2017, is hereby re-instated into service with effect from 08.05.2017 i.e. the date of his removal from service. The matter of back benefits for the intervening period from 08.05.2017 to date during which he remained out of service, shall depend upon final outcome of denovo proceedings to be initiated against him in due course of time in the light of FST judgment

No. 2063-C-III/2019:-In pursuance of judgment dated 11.07.2019 passed by Federal Service Tribunal, Lahore in Appeal No.496(L)CS/2017, Asad Mahmood, Ex-Inspector, Model Customs Collectorate, Sialkot who was compulsorily retired from service vide FBR’s Notification No.1428-C-III/2017 dated 08.05.2017, is hereby re-instated into service with effect from 08.05.2017 i.e. the date of his Compulsory Retirement. The matter of back benefits for the intervening period from 08.05.2017 to date during which he remained out of service, shall depend upon final outcome of denovo proceedings to be initiated against him in due course of time in the light of FST judgment.

    07. No. 2066-C-III/2019:- In pursuance of judgment dated 11.07.2019 passed by Federal Service Tribunal, Lahore in Appeal No.498(L)CS/2017, Syed Akmal Hussain Shah, Ex-Inspector, Model Customs Collectorate, Sialkot who was compulsorily retired from service vide FBR’s Notification No.1430-C-III/2017 dated 08.05.2017, is hereby re-instated into service with effect from 08.05.2017 i.e. the date of his Compulsory Retirement. The matter of back benefits for the intervening period from 08.05.2017 to date during which he remained out of service, shall depend upon final outcome of denovo proceedings to be initiated against him in due course of time in the light of FST judgment

    08. No. 2060-C-III/2019:- In pursuance of judgment dated 11.07.2019 passed by Federal Service Tribunal, Lahore in Appeal No.495(L)CS/2017, Shafqat-uz-Zaman Cheema, Ex-Inspector, Model Customs Collectorate, Sialkot who was compulsorily retired from service vide FBR’s Notification No.1429-C-III/2017 dated 08.05.2017, is hereby re-instated into service with effect from 08.05.2017 i.e. the date of his Compulsory Retirement. The matter of back benefits for the intervening period from 08.05.2017 to date during which he remained out of service, shall depend upon final outcome of denovo proceedings to be initiated against him in due course of time in the light of FST judgment.

    09. No. 2064-C-III/2019:- In pursuance of judgment dated 11.07.2019 passed by Federal Service Tribunal, Lahore in Appeal No.497(L)CS/2017, Mirza Muhammad Imran Baig, Ex-Inspector, Model Customs Collectorate, Sialkot who was compulsorily retired from service vide FBR’s Notification No.1432-C-III/2017 dated 08.05.2017, is hereby re-instated into service with effect from 08.05.2017 i.e. the date of his Compulsory Retirement. The matter of back benefits for the intervening period from 08.05.2017 to date during which he remained out of service, shall depend upon final outcome of denovo proceedings to be initiated against him in due course of time in the light of FST judgment.

    10. No.2059-C-III/2019: – In pursuance of judgment dated 11.07.2019 passed by Federal Service Tribunal, Lahore in Appeal No.494(L)CS/2017, Mr. Muhammad Javed, Ex-Inspector, Model Customs Collectorate, Sialkot who was removed from service on 08.05.2017 and subsequently converted into compulsory retirement vide FBR’s Notification No.2298-C-III/2017 dated 22.08.2017, is hereby re-instated into service with effect from 08.05.2017 i.e. the date of his removal from service. The matter of back benefits for the intervening period from 08.05.2017 to date during which he remained out of service, shall depend upon final outcome of denovo proceedings to be initiated against him in due course of time in the light of FST judgment.

    Customs intelligence official awarded ‘dismissal from service’ on corruption charges

    ISLAMABAD: Federal Board of Revenue (FBR) has imposed major penalty of ‘dismissal from service’ upon customs intelligence official on the charges of corruption, misconduct and inefficiency.

    In a notification issued on Wednesday, the FBR said that disciplinary proceedings under Government Servants (Efficiency & Discipline) Rules, 1973 were initiated against Muhammad Afzal, Superintendent (BS-16) (Time Scale BS-17) (under suspension), Directorate of Intelligence & Investigation-Customs, Karachi vide Charge Sheet No.2(90)/2012-Cus-III dated 20.04.2017.

    Ms. Saadia Sheeraz, the then Additional Director, Directorate of Customs Valuation, Karachi was appointed as Inquiry Officer to conduct inquiry on account of various acts of omission and commission committed by the accused officer constituting “Inefficiency”, “Misconduct” and “Corruption”.

    The Inquiry Officer submitted inquiry report dated 05.06.2018, according to which the charges of “Inefficiency”, “Misconduct” and “Corruption” were established against the accused officer.

    A Show Cause Notice dated 19.06.2018 was issued to the accused officer and in response, he submitted his defence reply. After considering the inquiry report, reply of the accused to the Show Cause Notice and his oral submissions during the personal hearing with the Authorized Officer on 01.08.2018, the accused officer has been found guilty of “Inefficiency”, “Misconduct” and “Corruption” under rule 3(a),(b)&(c) of the Government Servants (E&D) Rules, 1973.

    The Member (Admn), being the Authority in this case, after having considered all aspects of the case and the recommendations of the Authorized Officer has, therefore, imposed the major penalty of “Dismissal from service” upon Muhammad Afzal, Superintendent under rule 4(1)(b)(iv) of the Govt. Servants (Efficiency & Discipline) Rules, 1973 with immediate effect.

    FBR said that the promotions of above mentioned officials would take effect from the date of their joining / charge assumption, subject to the condition that no disciplinary proceedings were pending against them.

    They will be on probation for a period of one year, extendable for further period, not exceeding one year, provided that if no order is issued by the day following the termination of probationary period, the appointment shall deem to be held until further order.

    Customs agents express concerns over delay in grounding of containers

    KARACHI: The Karachi Customs Agents Association (KCAA) has expressed concerns over the delay in grounding of containers at Karachi International Container Terminal Ltd. (KICTL) and said it may result in choking of the terminal.

    In a letter sent to KICTL management on Tuesday, the KCAA pointed out the issue regarding delay in grounding of containers at the terminal.

    The KCAA has been informed by its members that they are facing unnecessary delays in clearance of their consignments within time from KICTL due to delay in grounding of containers marked for the examination.

    It has been observed that since last two to three weeks backlog of the containers is increasing day by day and still there is a backlog of 8 to 10 days.

    If the situation remains unresolved, there is no doubt that the terminal will be choked, due to this reason the trade will be affected very badly and will also bear heavy financial losses in shape of container detention and port demurrage charges, consequently the cost of doing business will increase.

    Furthermore, in view of the forthcoming Eid-ul-Azha holidays the impact of container backlog will increase significantly.

    It is pertinent to mention here that shortage of cargo handling equipments / machinery at KICTL is observed. While any new vessel is berthed all equipments / machinery are shifted towards for unloading of cargo from that vessel, thus the containers grounding process is delayed.

    The KCAA suggested that in order to facilitate the trade the grounding of containers should be on first priority and thereafter the process of unloading the cargo from vessel be carried out after completion of grounding work.

    Further, it is also observed that while the members are approaching to KICTL for deliveries of their consignments within the free days period but unfortunately, KICT staff informed that the container still remain on vessel so that they are unable to give the delivery, which is one the cause for delay and unnecessary demurrage being accumulated on the goods without fault of our members.

    “In this context, we have come to know through our reliable members that Free Days period is being calculated by the KICTL from the date of vessel berth whereas the free days must be started when the container is unloaded from the vessel,” the KCAA said.

    The FBR imposed the major penalty of “Reduction to the lower post of Appraising Officer” upon Amir Ahmad Samoo, Principal Appraiser (BS-16), Model Customs Collectorate of Appraisement-West, Karachi. The FBR found the official guilty of misconduct and inefficiency.

    The FBR imposed the major penalty of “Compulsory Retirement” upon Rao Muhammad Aslam, Appraising Officer/ (Examiner) (BS-16), Model Customs Collectorate of Appraisement-East, Karachi. The FBR found the official guilty of misconduct and inefficiency.

    The FBR imposed the major penalty of “Reduction to a lower post of UDC” upon Nasir Iqbal, Inspector (BS-16) (Posted as Examining Officer) in Model Customs Collectorate (Appraisement-West), Karachi. The FBR found the official guilty of misconduct and inefficiency.

    ISLAMABAD: Pakistan Customs has deployed additional staff at Torkham border to activate round the clock operation to facilitate trade, a statement said on Friday.

    It said that in compliance with the directions of Prime Minister of Pakistan, the Pakistan Customs has deputed additional staff at Torkham border to facilitate trade and expedite clearance of baggage and cargo.

    In this regard, the Advisor to the Prime Minister on Establishment matters Arbab Shezad had convened meetings to address the matter on war footing, accordingly Dr. Jawwad Uwais Agha, Member Customs (Operations), Federal Board of Revenue, Islamabad has deployed a large number of customs personnel to cater to the urgent requirements at Torkham Customs.

    While elaborating FBR’s seriousness, Chairman FBR Syed Shabbar Zaidi said that the exports and Transit to Afghanistan bear much promise for expansion of the customs operations at Torkham and the customs department being the premier agency has put its teams in place to brace upto this situation.

    Chairman further informed that around 12 thousand passengers traverse across this border station daily and their facilitation and baggage clearance is an area being addressed by Customs, besides around 300 empty containers (after offloading their cargo in Afghanistan) are also sent back daily from the Afghan side.

    To implement the directions, 54 customs personnel consisting of Superintendents, Appraisers, Inspectors and other supporting staff have been withdrawn from other formations and deployed at Model Customs Collectorate of Appraisement Peshawar for Torkham.

    Although the customs formations are badly short in strength and request for creation of different posts is under consideration of Finance Department, however in order to give compliance to the directions of Prime Ministers Advisor on Establishment and the urgent need for expansion of the operations at Torkham, the Member (Customs Operations) has made all efforts and withdrawn customs staff for deployment in order to facilitate and expand the trade at Torkham.

    The customs clearance will be managed through three shifts. The day and night customs clearance operations will greatly facilitate the import and export at Torkham leading to significant reduction of transport charges and fast movement of trade.

    As a prelude the customs operations have already been expanded starting from 7.00 A.M. in the morning till 9.00 pm, since the past two months. The senior Customs Operations hierarchy have paid visit to Torkham to ensure launch of these operations in the coming days.

    The connecting requirements for equipments and support apparatus are being placed on ground through the cooperation of Khyber Pakhtunkhwa government.

    The said operations for round the clock are going to be started shortly for which formal ceremony will also take place in the presence of federal government high ups and FBR administration.

    Pakistan Customs seizes huge quantity of Indian white sugar

    ISLAMABAD: Pakistan Customs has seized huge quantity of Indian origin white sugar, which was to be used in Afghanistan.

    Pakistan Customs Directorate General of Afghan Transit has seized a huge number of Indian origin consignments mis-declared as ‘White Sugar’, destined to be consumed in Afghanistan, said a statement on Friday.

    After confirmation through laboratory tests, the sugar is found to be “unfit for human consumption. So far 4472 Metric Tons in172 Containers out of 258 Containers have been tested by Laboratories and reported as ‘unfit for human consumption’, the rest of the 2236 Metric Tons (86 containers) are under investigation, the statement said.

    The harmful intake of this ‘expired sugar’ emanating foul smell and having turned brownish in colour would have seriously endangered the health of Afghan nationals had it made its way to the markets in Afghanistan.

    In continuing to play its mandated role in ‘Protection of Society’, Customs at the operational level is further enhancing its enforcement efforts and information network, without compromising on trade facilitation.

    FBR redeploys 1,650 customs officials to curb smuggling

    ISLAMABAD: The Customs Wing has re-deployed and transferred 1,650 official positions to meet the challenging revenue target and particularly to control smuggling.

    A statement said that in this context, a total of 180 posts in BS-16 have been re-designated while 1,568 posts in BS-16 have been redeployed across Pakistan. This shake up has not been kept limited to low grade positions but also 84 posts in BS-17 to BS-21 have also been re-deployed.

    The bulk of the re-deployed customs officers have been shifted to strengthen the Customs enforcement side.

    The transfer and posting orders have been issued. As a consequence of this re-deployment the Torkham corridor will become operational round the clock. The orders will enable the government to meet the demand from trade and industry to curb smuggling.

    Customs automation efforts have lately been enabling it to handle more trade efficiently and reduce its reliance on human interface. Under Prime Minister’s instructions the Chairman Syed Shabbar Zaidi has instructed Customs to improve ease of doing business by expediting initiatives like implementation of WeBOC-Glo, ITTMS and trade related Pakistan Single Window.
