    Draft MoU for sharing taxation data sent to China

    ISLAMABAD: Pakistan has sent draft Memorandum of Understanding (MoU) to China for sharing taxation data between the two countries.

    Federal Board of Revenue (FBR) Chairman Syed Muhammad Shabbar Zaidi on Monday sent the draft Memorandum of Understanding (MoU) on cooperation between FBR and China’s State Administration of Taxation in order to share taxation data between both the countries.

    A statement said that the draft MoU has been sent through a letter addressed to Pakistan’s Ambassador in China Ms Naghmana A. Hashmi.

    In this regard, Pakistan’s Ambassador in China has been authorized to sign the MoU on behalf of FBR.

    The FBR chairman in his letter has stated that the signing of the MoU will enable the Taxation Authorities of both the countries to share data and learn from each other’s best practices.

    The MoU will promote improvement in trade and investment in both countries.

    ISLAMABAD: Shabbar Zaidi, Chairman, Federal Board of Revenue (FBR) on Friday said that the government will not compromise documentation of economy by surrendering condition of CNIC on purchases.

    He said that the condition of CNIC had been enforced on purchases above Rs50,000.

    Speaking at a seminar organized by Sustainable Development Policy Initiative (SDPI) on Wednesday, he said that priority of the government was to enhance the tax net and expend tax base to documenting the country’s economy. And taxation is the only way to forward for equitable distribution of wealth, as we cannot have stabilized and equitable society unless we have a fare taxation system, he added.

    The FBR chairman said that due to presumptive tax regime, we actually dissociated the taxation from the economy, where taxing the real income was out of question.

    The incumbent government and the International Monitory Fund (IMF) are on the same page, as there was no disagreement by the government on the measures proposed by the IMF, especially the taxation measure, he said.

    The chairman said that the government would not bow down against the pressure, protests and lame excuses of the businesses and industries.

    Over the decades the policies of the successive governments make Pakistan a trading state rather a sami-manufacturing state, where the country is importing everything from mineral water to foods items and never worked-out on import substitution.

    While raising the concerns over the open transit trade agreement with Afghanistan, he said the agreement was being exploited and abused by the smugglers which negatively impacted the local industry.

    Pakistan needed to review this agreement and should take stringent measures to control illicit trade on Pak-Afghan border, he said.

    There are around 100 thousand companies registered with the government of Pakistan, where only 60 thousands file their returns, which shows the level of tax compliance.

    He said the measures taken in the current federal budget would fundamentally change the course of history of Pakistan.

    The government was taking steps to redress the institutional corruption through automation of the taxation system, the Chairman FBR said.

    He said that it is his responsibility to improve the tax base under the leadership of Prime Minister Imran Khan.

    Hawala and Hundi have inflicted a huge loss on the country’s economy,” he said and added measures were being taken to include the middle class in the tax net.

    FBR warns stern action against under-invoicing, mis-declaration

    ISLAMABAD: Federal Board of Revenue (FBR) has decided to launch drive against manufacturers and importers indulged in under invoicing and incurring huge revenue losses to national exchequer.

    FBR chairman Syed Shabbar Zaidi, in a statement, warned such manufacturers and importers to abstain from misdeclaration and under-invoicing.

    The statement said that the smuggling was the greatest menace but under-invocing and misdeclaration of imported goods were also depriving the country from actual revenue collection.

    The chairman warned manufacturers and importers that in case misreporting or under-invoicing was detected then stern action would be taken under relevant provisions of laws.

    The statement said that smuggled goods have badly dented the local manufacturing. The prime minister noticed the huge quantum of smuggling and directed the authorities to take all measures to stop the menace.

    In order to comply with the directives of the prime minister, Pakistan Customs enhanced the enforcement against illegal movements of goods.

    FBR bans entry of unauthorized persons, Lappoos into custom houses

    KARACHI: Federal Board of Revenue (FBR) has restricted entry of unauthorized persons, including privately hired persons by customs officials (Lappoos), into custom houses with immediate effect.

    In a statement issued on Monday, Pakistan Customs said that FBR chairman Syed Muhammad Shabbar Zaidi ordered the ban on entry of unauthorized persons into customs station in order to ensure transparency in clearance system.

    The FBR chairman while taking notice of presence of large number of visitors for making the entire clearance system doubtful, had ordered Customs Wing to strictly restrict, entry into Customs Houses, only to the concerned traders, their authorized representatives and members and relevant trade bodies/ associations.

    Accordingly Customs Wings is in process of issuing instructions to its field formations for immediately restricting entry of all un-authorized persons, the statement said.

    The visiting hours for traders and their authorized representatives for fulfillment of needed legal formalities in cases involving second review before Assistant / Deputy Collectors shall be limited from 10:00 Am to 1:00 PM.

    The press release said that Pakistan Customs is operating its Web Based One Customs (WeBOC) system in order to facilitate the trade and provide ease of doing business in carrying out imports, exports and transit trade.

    This system is available 24/7 and allows on-line submission and processing of documents as well as electronic payments of duty and taxes.

    As such the need for traders and their representatives to physically visit offices of Customs has drastically been reduced.

    KARACHI: Pakistan has approached the IMF for a new loan program due to bad economic conditions of the country, Advisor to Prime Minister on Finance Dr. Hafeez Shaikh said on Thursday.

    Advisor to PM Dr. Hafeez Shaikh was addressing a press conference at Governor House, Sindh. Governor Sindh Imran Ismail and Chairman Federal Board of Revenue (FBR) Shabbar Zaidi was also at the press conference. A large number of businessmen were also at the event.

    He said that in order to strengthen the economic condition the government had planned sort-, medium- and long term programs.

    The advisor and the FBR chairman briefed about the IMF loan program and amnesty scheme.

    Imran Ismail said that the government wanted to resolve industries problem at their doorstep.

    In this regard Sindh Industrial Liaison Committees were formed to speed up the resolution process.

    On the occasion, FBR chairman said that the latest amnesty scheme was supported by the entire business community.

    He said that amnesty scheme would generate sizeable revenue which would bode well for the country’s economy.

    Shipping agents demand forming task force to eliminate under/over invoicing

    KARACHI: Shipping agents have demanded the Federal Board of Revenue (FBR) to form taskforce / joint investigation team (JIT) to eliminate the menace of under / over invoicing, mis-declaration and smuggling in Pakistan.

    In a letter to the chairman of FBR Syed Muhammad Shabbar Zaidi, the Pakistan Ship’s Agents Association (PSAA) congratulated the chairman for his appointment as chief of the national tax collecting agency.

    The association said that the menace of smuggling was causing massive losses to the exchequer and also resulting in bad name of the country.

    “It is everybody’s knowledge that none of these nefarious activities can be carried out without facilitators/go-betweens,” the association said.

    “We believe that some of these facilitator types have FIRs already registered against them they should be fully investigated / dormant files should be revived.”

    “FBR should appoint a taskforce / JIT to address this issue on a war footing and all these culprits should be vigorously be pursued, caught and prosecuted.”

    The association said that customs intelligence, FIA, all border authorities, ministry of interior etc should all form special JIT to finish off this menace under the direct monitoring of the Prime Minister of Pakistan.

    The association further said that such types of facilitators were the enemies of the economy of the country. “We have also requested all our members from the maritime sector to keep a special watch for such facilitators and report immediately to concerned authorities.”

    KARACHI: Federation of Pakistan Chambers of Commerce and Industry (FPCCI) has praised the newly appointed chairman of Federal Board of Revenue (FBR) for limiting powers of Inland Revenue officers in tax recovery through bank account attachment.

    Engr. Daroo Khan Achakzai, President FPCCI in a statement on Saturday hailed the directive of the newly appointed Chairman FBR Shabbar Zaidi, for not attaching the bank account of a taxpayer unless his Chief Executive Officer / Owner is informed at least 24 hours prior to attachment and approval of the Chairman FBR is obtained.

    He said that the FPCCI had been clamoring for long for keeping a deterrent against the misuse of discretionary powers by the tax officials for recovery of arrears and attachment of bank account under Section 48 of Sales Tax Act, 1990 and Section 140 of Income Tax Ordinance 2001.

    The FPCCI Chief elaborated that there were increased incidences of bank account attachment and other serious coercive measures taken by the tax officer under the garb of the Section 48 for recovery of arrears and such abuse of powers were creating trust deficit and lack of confidence of taxpayers in law which are pre-requisite for success of any scheme.

    Achakzai hoped that the directive would address the complaints of business community about the unnecessary attachments of the bank accounts for recovery of the disputed accounts from the bank accounts of the taxpayers without fulfilment of legal process. “In many cases accounts have been attached without prior notice of the CEO / principle officer owner of the business community,” he added.

    PTBA assures full support to new FBR chairman

    KARACHI: Pakistan Tax Bar Association (PTBA) has assured full support to Syed Muhammad Shabbar Zaidi, newly appointed chairman of Federal Board of Revenue (FBR).

    In a statement issued on Saturday PTBA welcomed the appointment of Shabbar Zaidi as chairman of Federal Board of Revenue (FBR).

    The tax bar declared the appointment of Shabbar Zaidi as positive step of the government.

    The PTBA congratulated Zaidi for taking the reins of FBR and agreeing to dedicate his time and energy for the betterment of the country.

    The statement said that Zaidi is a globally known professional and is bringing with him the wealth of in-depth knowledge of taxation system, Pakistan economy and the problems which are holding it back.

    “We hoped under his leadership along with the team members of FBR the structural flows in the revenue collection system will improve,” according to the statement.

    The PTBA assured the newly appointment FBR chairman of their full support and cooperation.

    KARACHI: SITE Association of Trade and Industry on Friday hailed the very first decision by Shabbar Zaidi after assuming the charge as the chairman of Federal Board of Revenue (FBR) regarding curtailing powers of tax officers in recovery cases.

    “First decision taken by the Chairman will restore confidence of tax filers on FBR,” Saleem Parekh, President SAI, said in a statement

    He said that the association was pleased with the balanced approach on handling recoveries taken by the freshly appointed Chairman FBR.

    The condition of the Chairman’s approval before seizing bank accounts would make the process transparent by limiting the discretionary powers of field officers.

    It is expected that the Chairman will devise policies that will channel the full force of FBR on broadening the tax base instead of subjecting the current tax payers to different types of annual audits.

    The chairman must realize that the only way to broaden the tax base is to make the cost of doing business of non-filers more than the cost doing business of filers.

    The current system is heavily in favour of non-filers. A filer is subjected to Income tax audit, sales tax audit, withholding tax audit & audits before issuance of Income tax exemptions u/s 153 and u/s 148 on an annual basis whereas non-filers are allowed to trade, buy cars and properties and travel.

    The energies of FBR will be better spent if the focus is on non-filers who continue to enjoy many privileges with impunity.

    He hoped that a culture of tax collection with transparency, respect and oversight will flourish under the dynamic leadership of Shabbar Zaidi where filers will be considered as partners of FBR instead of adversaries.
