    No tax amnesty, no tax rate cut under IMF program: FBR chief

    KARACHI: The chairman of Federal Board of Revenue (FBR) Asim Ahmad on Saturday said that under ongoing program of the International Monetary Fund (IMF) the government committed for not granting any tax amnesty scheme and no tax rate cut.

    FBR chief was talking to business community at the Federation of Chamber of Commerce and Industry (FPCCI) during his visit to the Federation House.

    He said that the government had agreed with the IMF for neither allow any tax amnesty nor allow tax rate cut under the loan program. “Therefore, all the stakeholders have to work together on the policy,” he added.

    The chairman admitted that under imports under Chapter 84 and 85 of Customs Act, 1990 was problem not only for the business community but it was also for the tax authorities as well. “Hopefully this issue will be resolved very soon,” he assured the business community.

    Asim Ahmed said that FBR never wanted to stop the clearance of parts and machinery. “Because industrial activity ensures revenue collection for the country,” he added.

    The chairman said that tax officials were in touch with the business community to resolve the issues.

    He said that tax reform commission had started its work soon after Ishaq Dar assumed as the finance minister. The chairman also informed that the tax audit would be conducted once in four year.

    The chairman said that the retailer and wholesaler sectors were not filing income tax returns, which was main hindrance in identifying true income. He said by enforcing the relevant tax laws on retail sector there was revenue potential of Rs20 billion. In contrast the tax authorities were able to collect only Rs6 billion from this sector.

    On the occasion, Suleman Chawla, senior Vice President of the FPCCI said that business community was uncomfortable on the issues of return filing and selection of audit. These issues should be resolved on priority.

    KARACHI: Federal Board of Revenue (FBR) may withdraw the mandatory condition of invoice and packing list in containers for subsequent examination and customs clearance.

    Asim Ahmad, chairman, Federal Board of Revenue (FBR) during his visit to Karachi Chamber of Commerce and Industry (KCCI) on Saturday responding on the issue of placement of invoice and packing list in containers of import cargo.

    The FBR Chairman, while totally agreeing to the business community, stated that FBR was well aware of this issue and has carried out an extensive exercise to understand it in light of global practices and found business community’s concerns valid. “The FBR was looking into to the possibility of withdrawing this condition,” according a statement issue by the KCCI quoting the FBR chairman as saying.

    Regarding customs valuation, he said that the entire process of valuation was being revamped which will be following the international market-based concept and the relevant law, in this regard, has already been amended.

    Several international publications were regularly posting prices of different types yarns from several origins/ countries which will be electronically linked with the revamped Valuation System wherein valuations will be regularly according to current international yarn prices, he added while speaking at a meeting during his visit to the Karachi Chamber of Commerce & Industry on Saturday.

    Chairman FBR, while referring to concerns expressed over unnecessary/illegal raids, assured to discuss the issue with DG Customs Intelligence and advised the members of business community to bring all such cases of unjustified raids to FBR’s notice so that action could accordingly be taken. A circular was also issued on 19th October wherein all FBR Field Formations have strictly been advised not to conduct raids.

    Commenting on issues emerging due to exemptions on import of black tea for FATA, PATA and Azad Kashmir, Asim Ahmed agreed that the exemptions were being misused but these exemptions will be ending on June 30, 2023. FBR devised a mechanism last year wherein, quota was fixed for these areas according to their production capacity. “It is now the stakeholders who should tell the FBR whether the situation has improved or not.” In response, the relevant importers informed that it was the other way around as imports have risen in these areas.

    Touching upon the issue of placement of invoice and packing list in containers of import cargo, Chairman FBR, while totally agreeing to Chairman BMG’s remarks, stated that FBR was well aware of this issue and has carried out an extensive exercise to understand it in light of global practices and found business community’s concerns valid therefore, the FBR was looking into to the possibility of withdrawing this condition.

    He further mentioned that withholding tax on inward remittances of indenters’ commission has been reduced from 5 percent to 1 percent in this year’s budget while the 13 percent Sales Tax being paid to the provincial exchequer will be discussed with Sindh Revenue Board.

    The chairman said that some delays in release of refund claims was occurring but a tranche has recently been released on 2nd November. The business community should carefully submit refund claims as many refund claims get delayed if marked deferred by the system.

    “FASTER system has been working smoothly yet if anyone faces delays in receiving refunds, they can seek assistance from FBR”, he added.

    He also advised all the Chief Commissioners to maintain complete coordination and liaison with the Karachi Chamber so that the grievances being faced by the business community in getting their taxation issues resolved could be minimized. He also promised to resolve the issues being faced by yarn trader period who are not allowed to claim refunds before 14 months while the 7.5 percent difference in duties/ taxes between the commercial and industrial importers of polyester yarn will also be reduced.

    Chairman BMG Zubair Motiwala, in his remarks, highly appreciated the present team of FBR for its extraordinary efforts in dealing with the FATF issue that resulted in Pakistan’s exit from the grey list. He said, “Things are moving in the positive direction as far as FBR is concerned but there are some issues which have remained chronic since so many years and these were not being addressed by the FBR. All these issues, which are hardly 4 to 5 in numbers, having no major impact on revenue should be resolved at the earliest so that the businesses as well as the economy starts performing.”

    He said that the Chapter 84 and 85 have brought the entire work to a complete halt and it was a matter of grave concerns that around 7,000 applications were in KCCI’s possession which have been lying pending only due to delays in approval from the State Bank of Pakistan. Stopping imports of essential raw materials, spare parts and even solar panels was not making any sense which have to be allowed so that the industrial wheels keep on spinning without any interruption.

    Zubair Motiwala was of the view that around US$3 to US$4 billion remain parked abroad which people simply don’t want to remit to Pakistan because of the exorbitant taxes on indenting commission hence, these taxes should be waived so that the desperately needed foreign reserves could be brought to Pakistan.

    Appreciating FBR’s move to revamp the valuation system, Zubair Motiwala advised to expedite the process with a view to provide some relief to the business community. “As the country faces severe energy crises, the import of solar panels has to be allowed without any hindrances which would be a great service to this nation”, he said, adding that around 650 vehicles which have already been imported and were lying at the ports must also be cleared by lowering the recently imposed 100 percent extra duty at the earliest.

    On the occasion, Vice Chairman BMG Jawed Bilwani stated that the FASTER system for refund claims was working absolutely fine after its launch but the business community has now been facing a lot of issues in getting their refund claims issued on time which often creates liquidity problem and needs to be addressed. “As per law, all refund claims must be processed within 72 hours so that the business community could not face any liquidity issues.”

    President KCCI Tariq Yousuf, while welcoming Chairman FBR, pointed out that Karachi’s share in GDP was around $165 billion, which was 43 percent of Pakistan’s national economic size & was projected to hit $193 billion in 2025. “Karachi’s role in Pakistan’s economic growth has been phenomenal & is growing at a tremendous pace. However, the ongoing economic issues, high cost of doing business & taxation matters have been affecting the productive capacity of the private sector whose competitiveness has been deteriorating”, he added.

    He was of the view that the high amount of tax cost for businesses, particularly the SMEs should be a matter of great concern for policymakers as this has been affecting Pakistan’s growth potential.

    While appreciating Chairman BMG Zubair Motiwala for his remarkable job as Chairman of the Anomaly Committee for Business, he said that out of various recommendations agreed by the then finance minister and Chairman FBR along with his team, many issues were still pending which need to urgently resolved with a view to create an enabling environment for sustainable economic growth.

    FBR auctions confiscated immovable properties on Nov 15, 2022

    Federal Board of Revenue (FBR) has announced to auction immovable properties that are confiscated under Section 138(2) of Income Tax Ordinance, 2001.

    The tax collecting wing of the FBR, Regional Tax Office (RTO), Gujranwala to auction the said properties on November 15, 2022.

    In a notice, the RTO said that the following properties have been confiscated by the FBR under Section 138(2) of the Income Tax Ordinance, 2001 and under Rules 158 to 173 of the Income Tax Rules, 2002:

    01. Plot No. 33-B, SIE-II, Gujranwala (2 kanal), Ramzan Steel Industries.

    02. Plot No. 35-B, SIE-II, Gujranwala (2 kanal), Ramzan Steel Industries.

    03. House No. A2-333, WECHS (Wapda Town), Gujranwala (10 Marla).

    Terms and conditions for the auctions are:

    01. All interested persons are abide by provisions as envisaged under section 138(2) of the Income Tax Ordinance, 2001 and Rules 158 to 173 of the Income Tax Rules, 2002.

    02. All interested persons to participate in the auction are bound to deposit a demand draft of Rs1.25 million in favor of the Commissioner Inland Revenue, Withholding Tax Zone, RTO, Gujranwala (Refundable), in case otherwise, the person will be prohibited.

    03. The successful candidate will bound to deposit the 25 per cent of bids amount at the spot and remaining amount will have to pay within 7 days.

    FBR issues circular to relax income tax return filing deadline

    ISLAMABAD: Federal Board of Revenue (FBR) has issued a circular to relax the return filing deadline up to November 30, 2022.

    The FBR issued Circular No. 17 of 2022 to extend the last date for filing income tax returns for tax year 2022 up to November 30, 2022 from October 31, 2022.

    It is second date extension for return filing for tax year 2022 granted by the FBR. Previously, the revenue body issued Circular No. 16 2022 last month to grant extension in date for filing income tax return to October 31, 2022 from September 30, 2022.

    The latest date extension has been granted in view of current flood situation in the country and requests from various trade bodies and tax bars.

    With the fresh date extension, taxpayers including salaried persons, business individuals, association of persons (AOPs) and companies other than having account year July to June would able to file the return of income.

    The corporate entities having financial year between July 01 to June 30 are required to file their income tax returns by December 31 every year.

    The FBR through SRO 978(I)/2022 dated June 30, 2022 issued income tax return form for tax year 2022 giving statutory time to taxpayers for making compliance in filing of return.

    Section 14 of Income Tax Ordinance, 2001, highlighted the categories of taxpayers, who are required to file their annual return of income and wealth statement.

    According to Income Tax Ordinance, 2001, following class of taxpayers are required to file return of income:

    — every company

    — every person (other than a company) whose taxable income for the year exceeds the maximum amount that is not chargeable to tax under this Ordinance for the year

    — any non-profit organization as defined in clause (36) of section 2;

    — every person whose income for the year is subject to final taxation under any provision of this Ordinance

    Any person not covered by above clauses are also required to file return of income who,—

    (i) has been charged to tax in respect of any of the two preceding tax years;

    (ii) claims a loss carried forward under this Ordinance for a tax year;

    (iii) owns immovable property with a land area of five hundred square yards or more or owns any flat located in areas falling within the municipal limits existing immediately before the commencement of Local Government laws in the provinces; or areas in a Cantonment; or the Islamabad Capital Territory;

    (iv) owns immoveable property with a land area of five hundred square yards or more located in a rating area;

    (v) owns a flat having covered area of two thousand square feet or more located in a rating area;

    (vi) owns a motor vehicle having engine capacity above 1000 CC;

    (vii) has obtained National Tax Number; or

    (viii) is the holder of commercial or industrial connection of electricity where the amount of annual bill exceeds rupees five hundred thousand;

    (ix) is a resident person registered with any chamber of commerce and industry or any trade or business association or any market committee or any professional body including Pakistan Engineering Council, Pakistan Medical and Dental Council, Pakistan Bar Council or any Provincial Bar Council, Institute of Chartered Accountants of Pakistan or Institute of Cost and Management Accountants of Pakistan; or

    (x) is a resident person being an individual required to file foreign income and assets statement under section 116A.

    The FBR said that filing of income tax return is also mandatory for persons or classes of persons notified by the Board with the approval of the Minister in-charge.

    It further said that return of income is also mandatory for every individual whose income under the head ‘Income from business’ exceeds rupees three hundred thousand but does not exceed rupees four hundred thousand in a tax year is also required to furnish return of income from the tax year.

    KARACHI: Pakistan on Monday announced extension in filing of income tax return by one month to November 30, 2022 from existing October 31, 2022.

    Finance Minister Ishaq Dar announced to extend the last date for filing return for tax year 2022.

    The minister said that October 31, 2022 was the last date for filing income tax returns, however on the request of representations of tax bar association and the business community, the government has decided to extend the date for one month up to November 30, 2022.

    The Federal Board of Revenue (FBR) has already given date extension from September 30, 2022 to October 31, 2022. It was second date extension for return filing tax year 2022.

    Previously, the FBR extended the date on the complaints from the stakeholders that many errors on the IRIS portals hampered the return filing activities.

    Although, currently many glitches have been addressed on return filing portal yet a large number of calculation errors still challenging the taxpayers.

    Tax experts said that that long march started by PTI chairman, Imran Khan caused political uncertainty which has adversely affected the business activities in Pakistan

    Pakistan Tax Bar Association (PTBA) and Karachi Tax Bar Association (KTBA) in different communications with the FBR chairman urged for the extension in last date because of the error in the IRIS portal.

    The experts also said that the IRIS portal is surrounded with many calculation errors which is preventing the taxpayers while filing their income tax returns.

    Therefore, the apex tax body urged the FBR to first remove errors on the portal and then provide statutory time to taxpayers in discharging their national duty.

    The unprecedented flash floods in the country have terribly affected the cash flow of many businesses and receivables of previous fiscal year from several parts of the country.

    The PTBA demanded the tax authorities of providing clear 90 days for return filing from the date when the portal is error free.

    Withholding tax rates on immovable property transactions during 2022-2023

    Federal Board of Revenue (FBR) has issued withholding tax rates on sale and purchase of immovable properties during the year 2022-2023.

    The FBR issued withholding tax card for 2022-2023 after incorporating changes brought through Finance Act, 2022 to the Income Tax Ordinance, 2001.

    Tax authorities collect withholding tax on sale of immovable property under Section 236C and on purchase of immovable property under Section 236K of Income Tax Ordinance, 2001.

    Following are the withholding tax rates on immovable property transactions and text of relevant sections under Income Tax Ordinance, 2001:

    WITHHOLIDNG TAX RATE ON SALE OF IMMOVABLE PROPERTY:

    The withholding tax rate is 2 per cent of gross amount of consideration received on sale of immovable property by persons who are on the Active Taxpayers List (ATL) under Section 236 C of Income Tax Ordinance, 2001. However, the rate shall be enhanced by 100 per cent to 4 per cent for persons not on the ATL.

    Section 236C. Advance Tax on sale or transfer of immovable Property

    (1) Any person responsible for registering, recording or attesting transfer of any immovable property shall at the time of registering, recording or attesting the transfer shall collect from the seller or transferor advance tax at the rate specified in Division X of Part IV of the First Schedule:

    Explanation,—For removal of doubt, it is clarified that the person responsible for registering, recording or attesting transfer includes person responsible for registering, recording or attesting transfer for local authority, housing authority, housing society, co-operative society, public and private real estate projects registered/governed under any law, joint ventures, private commercial concerns and registrar of properties.

    Provided that this sub-section shall not apply to a seller, being the dependant of a Shaheed belonging to Pakistan Armed Forces or a person who dies while in the service of the Pakistan Armed Forces or the service of Federal or Provincial Government, in respect of first sale of immovable property acquired from or allotted by the Federal Government or Provincial Government or any authority duly certified by the official allotment authority, and the property acquired or allotted is in recognition of or for services rendered by the Shaheed or the person who dies in service:

    Provided further that if the seller or transferor is a non-resident individual holding Pakistan Origin Card (POC) or National ID Card for Overseas Pakistanis (NICOP) or Computerized National ID Card (CNIC) who had acquired the said immovable property through a Foreign Currency Value Account (FCVA) or NRP Rupee Value Account (NRVA) maintained with authorized banks in Pakistan under the foreign exchange regulations issued by the State Bank of Pakistan, the tax collected under this section from such persons shall be final discharge of tax liability in lieu of capital gains taxable under section 37 earned by the seller or transferor from the property so disposed of.

    (2) The Advance tax collected under sub-section (1) shall be adjustable

    Provided that where immovable property referred to in sub-section (1) is acquired and disposed of within the same tax year, the tax collected under this section shall be minimum tax.

    (4) Sub-section (1) shall not apply to:—

    (a) a seller, if the seller is dependent of:

    (i) a seller, if the seller is dependent of:

    a Shaheed belonging to Pakistan Armed Forces; or

    (ii) a person who dies while in the service of the Pakistan Armed Forces or the Federal and Provincial Governments; and

    (b) to the first sale of immovable property which has been acquired or allotted as an original allottee, duly certified by the official allotment authority.

    WITHHOLDING TAX RATE ON PURCHASE OF IMMOVABLE PROPERTY:

    The withholding tax rate on purchase of immovable property is two per cent on persons on the ATL under Section 236K of the Income Tax Ordinance, 2001. However, this rate shall be increased by 250 per cent to 7 per cent for persons not on the ATL.

    Section 236K. Advance tax on purchase or transfer of immovable property

    (1) Any person responsible for registering, recording or attesting transfer of any immovable property shall at the time of registering, recording or attesting the transfer shall collect from the purchaser or transferee advance tax at the rate specified in Division XVIII of Part IV of the First Schedule.

    Explanation,—For removal of doubt, it is clarified that the person responsible for registering, recording or attesting transfer includes person responsible for registering, recording or attesting transfer for local authority, housing authority, housing society, co-operative society, public and private real estate projects registered/governed under any law, joint ventures, private commercial concerns and registrar of properties.

    (2) The advance tax collected under sub-section (1) shall be adjustable:

    Provided that if the buyer or transferee is a non-resident individual holding a Pakistan Origin Card (POC) or National ID Card for Overseas Pakistanis (NICOP) or Computerized National ID Card (CNIC) who has acquired the said immovable property through a Foreign Currency Value Account (FCVA) or NRP Rupee Value Account (NRVA) maintained with authorized banks in Pakistan under the foreign exchange regulations issued by the State Bank of Pakistan, the tax collected under this section from such persons shall be final discharge of tax liability for such buyer or transferee.

    (3) Any person responsible for collecting payments in installments for purchase or allotment of any immovable property where the transfer is to be effected after making payment of all installments, shall at the time of collecting installments collect from the allotee or transferee advance tax at the rate specified in Division XVIII of Part IV of the First Schedule:

    Provided that where tax has been collected along with installments, no further tax under this section shall be collected at the time of transfer of property in the name of buyer from whom tax has been collected in installments which is equal to the amount payable in this section.

    (4) Nothing contained in this section shall apply to a scheme introduced by the Federal Government, or Provincial Government or an Authority established under a Federal or Provincial law for expatriate Pakistanis:

    Provided that the mode of payment by the expatriate Pakistanis in the said scheme or schemes shall be in the foreign exchange remitted from outside Pakistan through normal banking channels.

    PTBA seeks clear 90 days for return filing after making portal error free

    Pakistan Tax Bar Association (PTBA) has demanded the tax authorities of providing clear 90 days for return filing from the date when the portal is error free.

    In a letter sent to Asim Ahmad, chairman, Federal Board of Revenue (FBR) on Friday, the PTBA requested that the taxpayers be provided the statutory period of clear 90 days for submission of their income tax returns from the day, the return is complete and portal is error free.

    Moreover, timely decision would not only be appreciated by the taxpayers/legal fraternity, who are working very hard day & night by playing their part towards the legal responsibility for contributing towards national exchequer but also in collection of taxes at the appropriate time.

    PTBA has already pointed out various technical and practical issues in the IRIS pre-defined formulas in the Income Tax Returns for Tax Year 2022 and we also endorse the stand / opinion / observations about system highlighted by our regional affiliated bars. However, as for as filing of Income Tax Return is concerned, tax machinery has not reached upto the mark to facilitate the taxpayers by providing error free, flawless and hassle free tax return forms.

    Presently, it appears that the FBR has shifted/moved all its legal obligations/duties towards the taxpayers and FBR has only become the office for reporting, holding the taxpayer’s refund, creating  illegal demands, using harsh recovery measures, charging heavy penalties, thrashing out the superior court decisions, illegal assessment on settled issues and squeezing the existing taxpayers; instead creating/providing opportunities for ease of doing business, of facilitating the taxpayer, making a balanced tax policy, harmonizing tax laws, reducing the tax litigation, broadening the tax base, promoting the tax culture and reducing the cost of doing business.

    That, the aforementioned situation is a big question mark on the transparency and integrity of the FBR and also increasing the gap of trust deficit and lack of confidence between taxpayer and tax authorities.

    The PTBA pointed out to the provision of section 114 of the Income Tax Ordinance, 2001 whereby every person is obliged to file tax return for a tax year on the form and manner as would be prescribed by the FBR for the relevant Tax Year i.e 30th day of September of each year as provided under section 118 of the Income Tax Ordinance, 2001.

    Non submission of the returns by the tax payers within due dates, not only entail the penalties but exclusion of name from the Active Tax Payer List (ATL).

    The obligations placed by law on the relevant officials of FBR through Rule 34A of the Income Tax Rules, 2002 as notified vide SRO.1185(I)2020 dated 06-11-2020 whereby certain timelines in notifying the income tax return forms have been laid down.

    As per sub-rule (2) to (4) of Rule 34A the draft of income tax return has to be notified for suggestions from all persons likely to be effected thereby on or before the first day of December of the financial year following the financial year to which the return relates by observing following timelines and procedure prescribed therein.

    Vide clause (e) of sub-rule (4) of Rule 34A it is clearly provided that final income tax return shall be made available on portal IRIS by thirty first day of January of the financial year following the financial year to which the return relates. Your good self would kindly note that from thirty first day of January till thirtieth of June is the period wherein all the deficiencies or corrections in the system can be taken care of and from 1st day of July every tax payer would have a clear 90 days’ time to submit his/it return.

    As against the legal requirement as prescribed by law the draft of income tax return for the T Y 2022 had notified on 21-06-2022 and final return was notified and made available on portal IRIS on 30-06-2022 which is still deficient, whereas it was required to be made available on thirty first day of January.

    In addition to the above, we also take the opportunity to further draw your kind attention to the following issues in the return which needs your immediate action:

    ISSUES OF RETURN

    That, as per law the tax payer is entitled to claim adjustment of his previous refunds against tax liability for the current tax year but the relevant column for adjustment of refund has illegally been blocked, which is against the fundamental rights and present scheme of law under the Income Tax Ordinance, 2001. In this regard an earlier letter was submitted to this good office dated 23-08-2022.

    That, we have already sent letter dated 27-09-2022 for issuance of clarification on the value of immovable property declared by the taxpayer (actual consideration paid, value fixed by D.C. or value fixed by FBR) is still pending and needs consideration, enabling the taxpayer to declare the value of immovable property.

    Similarly, the draft of manual return of income for the Individuals and AOPs for the Tax Year 2022 was issued as late as on 26-08-2022 whereas the final SRO.1733(I)/2022 has been issued on 13-09-2022. Meaning thereby only 47-days’ time has been allowed to file the manual returns which is insufficient as provided under law supra.

    Similarly, the draft SRO.1829(I)/2022 for Tax Chargeable/Payments under section 7-E for the Individuals for the Tax Year 2022 was issued on 03-10-2022, whereas the final SRO.1891(I)/2022 has been issued on 13-10-2022. Meaning thereby only 17-days’ time has been allowed to charge, deposit and file the returns which is insufficient as provided under law supra.

    That, after the final notification vide SRO.1891(I)/2022 dated 13-10-2022 and insertion of new annexure of 7-E in return, which was issued late of three and half month after the final notification of return has opened a new set of requirement that require un-necessary data fields regarding the description/categories of property, locality details of property and detail of exempt properties.

    That, multiple SRO’s have been issued for valuation of properties under section 68 of the Income Tax Ordinance, 2001 consisting of thousands pages each SRO and frequently changed/amended and no updated separate list of SRO is available, which will also increase the risk of error and mistakes. In order to streamline the process and ease of taxpayer and legal fraternity; the FBR should issue a final amended notification enabling the taxpayer and tax advisors to complete their work.

    Similarly, the draft SRO.1892(I)/2022 for further amendments in Income Tax Rules, 2002 for the Non-resident Ship Owner or Charterer, Non-resident Air Craft Owner or Charterer, Simplified Return of Income for Retailer having turnover less than 10 (Million), Simplified Return for Individual/AOP having turnover upto 50(Million) and changes in Computation of Income Tax Return for the Tax Year 2022 was issued on 13-10-2022, whereas the final SRO.1955(I)/2022 has been issued on 24-10-2022. Meaning thereby only 07-days’ time has been allowed to charge, deposit and file the returns which is insufficient as provided under law supra.

    That the income tax return form introduced for SMEs sector has been issued on the IRIS system without sharing a Draft of the same as required under sub-section (2) of section 100E read with section 237 of the Ordinance. However, it has also been noted that the simplified return for SME uploaded without issuing the draft return, the same may lead to illegality. It is therefore, suggested that issue draft followed by final return be issued to meet with the requirement of law; enabling the taxpayers to avail the benefits for SME sector provided under section 2(59A) of the Ordinance.

    That, the IRIS portal is calculating incorrect initial depreciation allowance on purchase of Plant & Machinery against the provisions, of section 23 read with the part-II, 3rd Schedule of the Income Tax Ordinance, 2001. In addition to aforementioned IRIS portal is also showing wrong written down balance on addition of fixed assets and calculating 50% on opening balance instead of addition of fixed assets during the year.

    That, under the head of capital gains under section 37A of the Income Tax Ordinance, 2001 the adjustment of brought forward capital losses on listed securities cannot be calculated due to non-availability of column for incorporating the values/figures.

    That, presently IRIS portal is calculating/charging the excess/ incorrect tax liability on income covered under section 153 of the Ordinance, on the basis of fixed/predefined wrong formulas due to which the taxpayers are bound to pay high tax instead of their actual tax liability, which is against the spirit of self-declaration and present scheme of law. De-freezing of attribution tabs and enabling the taxpayers to enter correct figures/data to filed their return in time may resolve the issue.

    That, the IRIS is illegally requiring Commissioner’s approval in such cases, where revision of Income Tax Return is made within 60 without of filing of original return, which is against the provisions of section 114(6) of the Income Tax Ordinance, 2001.

    That, another issue regarding the downloading of Computerized Payment Receipt (CPR), the system shows message “Challan / CPR does not Exist” against the valid CPR duly deposited in the national exchequer.

    FBR issues tax rates on property sale through auction during 2022-2023

    Federal Board of Revenue (FBR) has notified withholding tax rates for sale of property through public auction during year 2022-2023.

    The FBR issued withholding tax card 2022-2023 after incorporating amendments made through Finance Act, 2022 to the Income Tax Ordinance, 2001.

    The revenue body collect withholding tax on sale of property through public auction under Section 236A of the ordinance.

    Following are the tax rates and text of the Section 236A.

    WITHHOLDING TAX RATES:

    — Any property or good other than immovable property, the tax rate is 10 per cent of gross sale price and the rate is 20 per cent for persons not on the Active Taxpayers List (ATL).

    — In case of immovable property, the tax rate is 5 per cent of gross sale price and the tax rate is 10 per cent in case persons are not on the ATL.

    Section 236A: Advance tax at the time of sale by auction.

    (1) Any person making sale by public auction or auction by a tender, of any property or goods (including property or goods confiscated or attached) either belonging to or not belonging to the Government, local Government, any authority, a company, a foreign association declared to be a company under sub-clause (vi) of clause (b) of sub-section (2) of section 80, or a foreign contractor or a consultant or a consortium or Collector of Customs or Commissioner of Inland Revenue or any other authority, shall collect advance tax, computed on the basis of sale price of such property and at the rate specified in Division VIII of Part IV of the First Schedule, from the person to whom such property or goods are being sold.

    Explanation.— For the removal of doubt it is clarified for the purpose of this section that—

    (a) the expression “sale by public auction or auction by a tender” includes renewal of a license previously sold by public auction or auction by a tender; and

    (b) where payment is received in instalments, advance tax is to be collected with each instalment.

    (2) The credit for the tax collected under sub-section (1) in that tax year shall, subject to the provisions of section 147, be given in computing the tax payable by the person purchasing such property in the relevant tax year or in the case of a taxpayer to whom section 98B or section 145 applies, the tax year, in which the “said date” as referred to in that section, falls or whichever is later.

    Explanation.- For the purposes of this section, sale of any property includes the awarding of any lease to any person, including a lease of the right to collect tolls, fees or other levies, by whatever name called.

    (3) Notwithstanding the provisions of sub-section (2), tax collected on a lease of the right to collect tolls shall be final tax.
