    Half a million people pay surcharge to get active taxpayer status

    ISLAMABAD: Nearly half of a million people have paid surcharge for appearance in Active Taxpayers List (ATL) to get benefit of exempt withholding tax or reduced rate of withholding tax on various types of transactions.

    Sources in Federal Board of Revenue (FBR) on Wednesday said that around 500,000 taxpayers who filed their income tax returns after due date had paid surcharge to appear on the ATL for tax year 2020.

    The FBR issues a fresh ATL on March 01 every year on the basis of returns filed for the preceding tax year. The FBR issued ATL for tax year 2020 on March 01, 2021. This ATL carried 2.17 million names of taxpayers who filed their income tax returns by due date or those who filed their returns on the date which was extended by Commissioner Inland Revenue (CIR).

    The updated ATL – on the basis of surcharge paid by those person who filed their income tax returns after due date –  issued on May 10, 2021 is showing around 2.65 million names of active taxpayers.

    The filing of income tax returns is mandatory for all the taxpayers who have taxable income or specified under Section 114 of Income Tax Ordinance, 2001.

    As per statute the compliance of mandatory return filing was not enough to avail the reduced rate facility. According to Section 182A of Income Tax Ordinance, 2001 the persons who fail to file annual return of income by due date or extended by commissioner Inland Revenue then their names would not be included in the active taxpayers list for the year for which return was not filed.

    However, the persons would be included in the taxpayers list on filing return after the due date, if they pay surcharge at: Rs20,000 in case of  a company; Rs10,000 in case of an association of persons; and Rs1,000 in case of an individual.

    ISLAMABAD: The number of active taxpayers has been increased to 2.6 million by April 25, 2021 for tax year 2020, according to latest data released by Federal Board of Revenue (FBR) on Monday.

    The weekly Active Taxpayers List (ATL) for tax year 2020 updated those taxpayers’ names, who filed their income tax returns up to last date or the date was extended by commissioner Inland Revenue or those taxpayers’ names who filed their income tax returns after the deadline but paid surcharge for appearance on the ATL.

    The FBR officials said that around 0.43 million taxpayers had enrolled their names in the ATL 2020 by filing returns and paying surcharge after the issuance of first ATL 2020 on March 01, 2021.

    The FBR has changed the mechanism for availing reduced rate of withholding tax on various transactions. Previously, the filers were entitled to avail exemptions or reduced rate of withholding tax rates on various types of transactions. But not a person has to file annual return by due date given by the FBR. In case a person fails to file annual return by due date but files after the due date, he will be not entitled to get his name in the ATL. However, it will only be possible after paying of surcharge to appear on the ATL.

    KARACHI: Around 400,000 taxpayers have paid surcharge for appearance on Active Taxpayers List (ATL) for tax year 2020, according to updated active taxpayers list issued on Monday by the Federal Board of Revenue (FBR).

    ISLAMABAD: Around 367,159 taxpayers have paid surcharge for appearance in the Active Taxpayers List (ATL) for availing exempt or reduced rates of withholding tax on various transactions.

    According to weekly updated ATL for tax year 2020 issued on Monday the number of active taxpayers increased to 2,545,622 on the basis of income tax return filed within due date and after payment of surcharge after due date by April 11, 2021.

    The Federal Board of Revenue (FBR) issued the new ATL for tax year 2020 on March 01, 2021 which carried 2,178,463 names of taxpayers, who were entitled to avail reduced or exempt rates of withholding tax on various transactions.

    ISLAMABAD: Around 60,000 taxpayers paid surcharge for including their names in Active Taxpayers List (ATL) for tax year 2020 during the week ended March 21, 2021.

    According to weekly updated ATL -2020 issued on March 22, 2021 by the Federal Board of Revenue (FBR), the number of active taxpayers increased to 2.43 million on the basis of return filed / surcharge payment for appearance on the ATL.

    The number of active taxpayers was 2.37 million in the preceding week.

    The FBR issued the ATL for the tax year 2020 on March 01, 2020 and the total number of active taxpayers on the list was 2.17 million.

    The appearance of taxpayers’ name on the ATL guarantees exemption from withholding tax on various transactions and reduction of withholding tax rate.

    The FBR includes names of only those taxpayers, who file their annual returns within due date or it was extended by commissioner appeals on the basis of request filed by the taxpayers.

    However, late filers can also enlist their names on the ATL after payment of surcharge.

    The payment of surcharge is Rs1,000 for individuals, Rs10,000 for Association of Persons and Rs20,000 is for corporate entities.

    According to latest ATL for tax year 2020 updated up to March 14, 2021 the number of active taxpayers has increased to 2.37 million as compared with 2.17 million persons in the ATL 2020 issued by the FBR on March 01, 2021.

    The appearance of taxpayers’ name on the ATL guarantees exemption from withholding tax on various transactions and reduction of withholding tax rate.

    The FBR includes names of only those taxpayers, who file their annual returns within due date or it was extended by commissioner appeals on the basis of request filed by the taxpayers.

    However, late filers can also enlist their names on the ATL after payment of surcharge.

    The payment of surcharge is Rs1,000 for individuals, Rs10,000 for Association of Persons and Rs20,000 is for corporate entities.

    Bank less bother to check taxpayers’ active status while deducting withholding tax

    KARACHI: In an interesting case an account holder suffered deduction of withholding tax at a higher rate on banking transactions despite the account holder’s name was on the Active Taxpayers List (ATL).

    According to a case study, a complainant lodged a complaint before the Banking Mohtasib Pakistan that the concerned bank had deducted withholding tax on the transactions while treating the account holder as non-file despite the fact the name was on the ATL.

    The case study revealed the complainant stated that he was maintaining a current account in his company’s name with a bank and was also a filer having registered tax payer status which also appeared in Active Taxpayer List (ATL) issued by Federal Board of Revenue (FBR).

    On January 23, 2019, the Bank’s branch deducted a sum of Rs 600/- from the Company’s account treating the Complainant as a Non-Filer to which he protested.

    The branch after completion of certain procedural formalities confirmed that henceforward no withholding tax on cash withdrawals will be recovered as the account status was of a filer, but to his surprise the bank continued recovering withholding tax and each time he was asked to furnish some more documents which he did accordingly, but to no avail.

    Upon reconciliation of his account, he found that the branch has recovered around Rs 293,000/- from the account since January 2019 towards tax deduction.

    On raising the issue, the branch verbally advised him to file income tax refund application with FBR which he found unjust because the branch had illegally recovered WHT from his account and did not rectify its own mistake despite notice since January 2019.

    He demanded that the bank should reverse the withholding tax and flag his account as a filer so that such a lapse did not recur.

    The bank did not pay any heed to his request. Therefore, he approached the office of Banking Mohtasib for redressal of this complaint.

    On Banking Mohtasib Pakistan query, the Bank informed that the said account was opened in November 2018 and the complainant approached the branch in September 2019 for marking of tax exemption on his account, provided NTN Certificate which was sent to the Bank’s central processing unit (CPU) for necessary updating in system, but the same was returned by CPU with the reason “Updated NTN Certificate is required”.

    The branch approached him and he confirmed that the provided certificate was the only updated one and no other certificate was available with him. The branch also checked the stated NTN number on the Bank’s Online Tax Verification Portal that gave NIL report apparently confirming that given certificate was not correct and updated one.

    Upon subsequent request by the branch, on a hit and trial error method basis started adding 0 to 9 in start and end of provided NTN number and checked each Online Tax Verification Portal.

    On query, the branch came to know that one digit (6) was missing on NTN Certificate and was added in writing by hand which is evident from attached certificate and finally account was marked Filer in October 2019.

    Since the deducted tax was already deposited in Government Treasury within 7 days after deduction and cannot be refunded, therefore, he was requested to obtain Tax Deduction Certificate from the Bank and claim advance tax deduction in his Tax Return of 2018-2019 or may lodge his tax refund claim with FBR on the basis of Tax Deduction Certificate.

    The Bank’s comments were shared with the Complainant who through his Income Tax Consultant stated that the last digit in any NTN number is called Check Digit which is not required to check the NTN details and /or ATL status of any tax payer, which showed that the concerned Bank officers (s) have never bothered to check the ATL status or NTN details of the tax payer.

    Upon sharing the above stance of the Complainant, the Bank asserted that the Bank’s internal system does not verify NTN without checking number. In order to ascertain the veracity of both parties’ assertion a demo was arranged in office of Banking Mohtasib Pakistan, visited FBR site for Online Verification System and put Registration No (without check digit) which gave the result that Complainant’s Filing status as “Active”.

    This clearly demonstrates that Bank’s misrepresented the facts to Banking Mohtasib which has been viewed very seriously.

    The Bank was, therefore, advised to refund or adjust the excess tax deducted from the Complainant’s account and the Bank may obtain the refund of the sum so paid from the FBR with the necessary help and coordination from the Complainant, if desired.

    The Bank, however, filed a Representation against the findings of the Banking Mohtasib before the President of Islamic Republic of Pakistan.

    ISLAMABAD: Federal Board of Revenue (FBR) has added around 116,801 taxpayers to the updated Active Taxpayers List (ATL) for tax year 2020 issued on Monday.

    The FBR updates the ATL on every Monday on a weekly basis. The revenue body issued new ATL for tax year 2020 on March 01, 2021. The recent list is the first update to the new ATL.

    The total number of active taxpayers in the new ATL – 2020 issued a week was 2,178,463. The weekly updated ATL issued on March 08, 2021 is carrying names of around 2,295,264 active taxpayers.

    The appearance of taxpayers’ name on the ATL guarantees exemption from withholding tax on various transactions and reduction of withholding tax rate.

    The FBR includes names of only those taxpayers, who file their annual returns within due date or it was extended by commissioner appeals on the basis of request filed by the taxpayers.

    KTBA recommends daily update of ATL file; banks not relying on online verification

    KARACHI: Karachi Tax Bar Association (KTBA) has advised the Federal Board of Revenue (FBR) to update Active Taxpayers List (ATL) on daily basis instead weekly as banks were not relying on the online verification of the active taxpayers for purpose of withholding tax deduction.

    The KTBA on Saturday said that many taxpayers are making payment of surcharge U/s.182A of the Income Tax Ordinance, 2001 (Ordinance) for inclusion of their names in the ATL and upon the payment the status of taxpayer is immediately updated in the ATL on the web portal.

    However, the excel file available on the FBR web portal of is not being updated which is causing severe problems to the taxpayers as far as withdrawals from banks are concerned.

    “The banks are not relying on the online verification available on the web portal of FBR,” the KTBA said.

    The KTBA suggested that the excel file (lists) available on the web portal of FBR is updated on daily basis and the banks are also informed to rely on the online verification before withholding deducting the tax on banking transactions in order to facilitate the taxpayers.

    The tax bar said that it had received many complaints that where manual extensions were filed/submitted and where no reply was received (whether granted or refused) and the returns were filed within the time applied for; the names of such taxpayers are also not appearing in the ATL though such cases are liable to be treated as filed within the time allowed.

    The KTBA advised that where taxpayers have filed the manual extensions within time and where the returns have been filed within the time applied for, the names of such taxpayers should be included in the ATL and the ATL be updated immediately without payment of surcharge as prescribed U/s.182A of the Ordinance.

    There are several instances where the taxpayers have opted rightly to file their returns, in time, manually (paper returns) as they were legally not bound to file their returns electronically, their names are also not appearing in the ATL for which we are being informed by our members continuously. We feel that the manual returns have not been digitized and such taxpayers are facing severe problems due to non-appearance of their names in the ATL.

    The tax bar suggested that where taxpayers have rightly filed/submitted their returns manually (paper turns), the names of such taxpayers should be included in the ATL forthwith for their facilitation.

    The KTBA also received complaints from members and have also noticed that there are instances where extension applications have been submitted via IRIS within time and the same are appearing in the outbox of IRIS unattended by the concerned Commissioners and the returns have also been filed within the time applied for but their names are not appearing in the ATL.

    The tax bar said that there is no fault of the taxpayers who have filed the extensions in time that remains unattended and the returns have also been filed within the time applied for.

    It suggested that where taxpayers have applied for extensions on IRIS in time, whose applications have remained unattended and the returns have been filed within the time, the names of such taxpayers should also be included in the ATL forthwith for their facilitation
