FBR notifies transfers, postings of Customs officials BS-19, BS-20
ISLAMABAD: Federal Board of Revenue (FBR) on Thursday notified transfers and postings of officers of Pakistan Customs Service (PCS) I BS-19 and BS-20.
The transfers and postings have been made with immediate effect until further orders.

01. Syed Shakeel Shah (Pakistan Customs Service/BS-20) has been transferred and posted as Director General (OPS), Directorate General of Reforms & Automation (Customs), Islamabad relieving Mr. Muhammad Imran Khan Mohmand (PCS/BS-21) of the look after charge of the post of Director General of Reforms & Automation (Customs), Islamabad. He has been transferred from the post of Chief, Federal Board of Revenue (Hq), Islamabad.
02. Ch. Muhammad Javaid (Pakistan Customs Service/BS-20) has been transferred and posted as Director, Directorate of Intelligence & Investigation, FBR, Quetta from the post of Collector, Collectorate of Customs, (Appeals), Karachi.

03. Fayaz Rasool (Pakistan Customs Service/BS-20). The officer is assigned the additional charge of Collector, Collectorate of Customs (Appeals), Karachi in addition to his own duties till the posting of a regular incumbent. He is presently posted as Director, Directorate General of Customs Valuation, Karachi.
04. Munib Sarwar (Pakistan Customs Service/BS-20) was awaiting posting, stationed at Lahore. He is presently posted as Director, Directorate of Intelligence & Investigation, FBR, Peshawar.
05. Naveed Iqbal (Pakistan Customs Service/BS-19) has been transferred and posted as Director (OPS), Directorate of Intelligence & Investigation, FBR, Peshawar from the post of Director, (OPS) Directorate of Intelligence & Investigation, FBR, Quetta.

06. Ms. Haleema Qasim (Pakistan Customs Service/BS-19) has been transferred and posted as Secretary, Federal Board of Revenue (HQ), Islamabad from the post of Additional Director, Directorate General of Customs Valuation, Karachi.
The FbR said that the Officers who are drawing performance allowance prior to issuance of this notification shall continue to draw this allowance on the new place of posting.
The officers have been directed to send charge Relinquishment/Assumption to FBR immediately after Relinquishment/Assumption of charge for record and further necessary action.

Customs examiner penalized for submitting misleading lab reports
ISLAMABAD: Federal Board of Revenue (FBR) has imposed major penalty upon a Customs chemical examiner for submitting wrong / misleading laboratory reports.
According to details disciplinary proceedings under the Civil Servants (Efficiency & Discipline) Rules, 2020 were initiated against Aftab Ahmad, Assistant Chemical Examiner (BS-17), while posted at Collectorate of Customs, Port Muhammad Bin Qasim, Karachi on July 13, 2021.

Engr. Habib Ahmed the then Additional Collector (PCS/BS-19), Collectorate of Customs (Exports), Karachi was appointed as Inquiry Officer to conduct inquiry on account of various omission and commission committed by the accused officer constituting “Inefficiency” and “Misconduct”.
The inquiry officer submitted in the report on April 09, 2022 according to which the charges of “Inefficiency” and “Misconduct” were established against the accused officer.
On the basis of inquiry report, a show cause notice was issued on May 28, 2022 to Aftab Ahmad, Assistant Chemical Examiner (BS-17), Collectorate of Customs Appraisement (West), Karachi.

He submitted reply to the Show Cause Notice, which was received in the Board on June 29, 2022, wherein he denied all the allegations/charges and requested that the Show Cause Notice is illegal and requires to be withdrawn.
He also requested personal hearing enabling him to explain his case in person as well.
In order to meet the ends of justice, opportunity of personal hearing was granted to the accused and the Authority appointed Member (Admn/HR) as Hearing Officer.
On August 22, 2022, the accused officer appeared before the Hearing Officer. During the course of personal hearing, the submissions made by the accused officer were found without evidence and merits for submitting wrong/misleading laboratory test reports.

Moreover, the Hearing Officer had observed that the accused officer had nothing new to say in his defense. Accordingly, the case was submitted to the Authority i.e. Secretary Revenue Division/Chairman, FBR for decision.
The Authority i.e. Secretary Revenue Division/Chairman, FBR, after having carefully considered the record of the case, the Inquiry Report, reply to the Show Cause Notice and submission made by the accused during the personal hearing before the Hearing Officer, observed that charges of “Inefficiency” and “Misconduct” under Rule 3(a) & (b) of Civil Servants (Efficiency & Discipline) Rules, 2020 stand established against the accused officer.

The Authority, therefore, imposed major penalty of “Reduction to a Lower Post as Deputy Assistant Chemical Examiner (BS-16)” for a period of three (3) years”, upon Aftab Ahmad, Assistant Chemical Examiner (BS-17), under Rule 4(3)(b) of the Civil Servants (Efficiency & Discipline) Rules, 2020.

FBR directs Customs officials to declare dual nationality
ISLAMABAD: The Federal Board of Revenue on Friday directed the officials of Pakistan Customs Service (PCS) to provide information related to dual nationality.
The FBR – the apex tax collecting agency of Pakistan – has circulated an official memorandum in this regard to all chief collectors/collectors of customs and all directors general of customs department.

According to the official memo, a format has been provided which will be filled by all officers of Pakistan Customs/Ex-Cadre BS-17 and above, for updation of data maintained by HRIS, FBR.
The officers have been directed that the necessary information should be submitted to the FBR latest by August 23, 2022.

The customs officers are required to provide information in case of holding dual citizenship. The details must include: name, designation, BPS (grade), service group, CNIC No., Current place of posting and dual nationality.
In case of married, the officers are required to provide details, which include: spouse name, spouse Pakistan’s CNIC Number, Spouse Pakistan Passport Number, Spouse country of other nationality, and date of acquisition of foreign nationality.

Whether the government servant is providing services or consultancy (temporary/regular/part time) to the local or international (or both) NGOs, community development organizations, community development corporation, non-profit organizations, thin tans, research organizations/centers, consultancy firms/organizations, in such cases the officers are required to provide details of name of organization/firm, role/designation in that firm and date of engagement with the concerned firm.

FBR imposes major penalty on Customs appraising officer
ISLAMABAD: The Federal Board of Revenue (FBR) has imposed major penalty of ‘compulsory retirement from service’ upon a customs appraising officer on the charges of misconduct and inefficiency.
According to a notification issued on Monday, the FBR said that disciplinary proceedings under Government Servants (Efficiency & Discipline) Rules, 1973 were initiated against Nihal Kazim, Appraising Officer (BS-16), Collectorate of Customs Appraisement (West), Karachi through a charge sheet issued on October 29, 2019.

Ms. Rabel Khokhar, Assistant Collector, the then Collectorate of Customs Appraisement, Customs House, Karachi was appointed as Inquiry Officer to conduct inquiry on account of various acts of omission and commission committed by the accused officer constituting “Inefficiency” and “Misconduct”.
The Inquiry Officer submitted Inquiry Report dated January 29, 2020, according to which the charges of “Inefficiency” and “Misconduct” were established against the accused officer.
A Show Cause Notice dated July 17, 2020 was issued to the accused officer and in response, he submitted his defence reply and also appeared for personal hearing before the Collector/Authorized Officer on August 11, 2020.

After considering the inquiry report, reply of the accused to the Show Cause Notice and his oral submissions during the personal hearing with the Authorized Officer, the accused officer has been found guilty of “Inefficiency” and “Misconduct”.
The Authorized Officer/ Collector recommended imposition of major penalty upon the accused. The Member (Admn/HR) / Authority before deciding the case afforded an opportunity of personal hearing to the accused on zoom/ telephone phone due to his illness on June 23, 2022.
The Member (Admn), FBR being “Authority” in this case, after having carefully considered case record, inquiry report, verbal submissions of the accused during hearing and recommendations of the Authorized Officer/ Collector has found no solid evidence and merits in the stance of the accused for his prolonged un-authorized absence from duty for three years.

Accordingly, the Member (Admn/ HR) / Authority has observed that the charges of “Inefficiency” and “misconduct” under Rule-3(a)&(b) of Civil Servants (E&D) Rules, 1973 stand established against the accused.
The Authority has, therefore, imposed major penalty of “Compulsory Retirement from Service” upon Nihal Kazim, Appraising Officer (BS-16), Collectorate of Customs Appraisement (West), Karachi under Rule 4(1)(b)(ii) of the Civil Servants (E&D) Rules, 1973. Moreover, his period of absence from duty i.e. November 20, 2016 till date is treated as Extra Ordinary Leave (EOL) and the excess amount drawn as pay and allowances is to be recovered from pensionary benefits.

He will have a right to file appeal against this Order to the Appellate Authority under Civil Servants (Appeals) Rules, 1977 within a period of 30 days from the date of communication of this Notification.

FBR’s committee to examine service record of customs officials
ISLAMABAD: The Federal Board of Revenue (FBR) on Wednesday constituted a scrutiny committee to examine service record of employees of Pakistan Customs Department.
According to a notification, on the directives of FBR chairman, the following scrutiny committee to examine the service record of all those employees of Pakistan Customs Department, who have joined their duties in pursuance of order dated December 17, 2021 passed by Supreme Court of Pakistan:

The FBR has mandated the committee to obtain the available record of all such employees from the concerned field formations and establishment division, if any of the required documents are not available with the respective offices.

It is also mandated to the committee to examine the complete service record of their initial appointment, termination from service and subsequent reinstatement under the Sacked Employees (Reinstatement) Ordinance Act, 2010, on case to case basis, and to determine their status in accordance with the judgment dated December 17, 2021 passed by the Supreme Court of Pakistan.
The FBR asked the committee to furnish conclusive report/recommendations in each case to Member (Admn/HR) through Chief (HRMC) preferably within two months time.
