Customs appraising officer awarded major penalty for inefficiency
KARACHI: A customs appraising officers has been awarded major penalty and demoted to lower scale on the charges of inefficiency.
According to the Federal Board of Revenue (FBR) on Friday, disciplinary proceedings were initiated against Syed Muhammad Fawad Ahmad, Appraising Officer Collectorate of Customs Exports (Port Muhammad Bin Qasim), Karachi through an order of inquiry dated August 02, 2022 on charge of inefficiency under Rules-3(a) of the Civil Servants (Efficiency & Discipline) Rules, 2020.

Muhammad Haris Ansari, Additional Collector (PCS/BS-19), Collectorate of Customs Appraisement (PMBQ), Karachi was appointed as Inquiry Officer to scrutinize the conduct of accused officer.
The Inquiry Officer submitted inquiry report on October 07, 2022 concluded that the charge of inefficiency stand established against the accused under Rule-3(a) of the Civil Servants (Efficiency & Discipline) Rules, 2020.

Based on the findings and recommendations of the inquiry report, a Show Cause Notice dated October 18, 2022 was served upon the accused. The accused officer furnished his reply to Show Cause Notice, on October 29, 2022.
The Member (Admn/HR)/ Authority provided an opportunity of personal hearing to the accused on November 29, 2022.

Whereas, the Member (Admn/HR)/ Authority after having gone through the available record of the case, the Inquiry Report, reply of the Show Cause Notice, and verbal submissions made by accused during the course of personal hearing. However the Authority has not agreed with recommendations of inquiry officer and, therefore, decided to impose a major penalty of “Reduction to a lower post and pay scale from the substantive or regular post, for a period of one year” under Rule-4(3)(b) of the Civil Servants (E&D) Rules, 2020 upon Syed Muhammad Fawad Ahmad, Appraising officer, Collectorate of Customs Exports (PMBQ), Karachi.

The Performance Allowance of the officer has also been stopped for one year from the date of award of the penalty as provided at Sr.No.7(iii) of FBR’s Circular No.1 of 2015 dated March 06, 2015 and he will have to appear afresh for restoration of the same.
The officer will have a right to appeal against this Order to the Appellate Authority under Civil Servants (Appeals) Rules, 1977 within a period of 30 days from the date of communication of this Notification.

FBR sacks customs officer on corruption charges
ISLAMABAD: The Federal Board of Revenue (FBR) on Wednesday imposed major penalty upon a customs officer on the charges of corruption, misconduct and inefficiency.
The FBR said disciplinary proceedings were initiated against Imran Fareed, Inspector (BS-16), Collectorate of Customs Enforcement, Lahore by the authority/ member (Admn/HR), FBR vide Order of Inquiry dated 19.01.2022 on account of omission and commission constituting ‘Inefficiency’ ‘Misconduct’ and ‘Corruption’ in terms of Rule-3(a),(b)&(c) of the Civil Servants (Efficiency & Discipline) Rules, 2020.
Basit Maqsood Abbasi, Collector (BS-20), Collectorate of Customs Enforcement, Lahore was appointed as Inquiry Officer to conduct inquiry proceedings under the Civil Servants (E&D) Rules, 2020.

The Inquiry Officer vide inquiry report dated 30.05.2022 concluded that all the charges as leveled in the order of inquiry stand established. The audio-visual clips relating to the case reveal his direct involvement in bargaining with the complainant/owner of the goods for demanding illegal gratification.
A Show Cause Notice dated June 17, 2022 was issued to the accused officer for defence reply and to afford him an opportunity of personal hearing by the Authority/ Member (Admn/HR), FBR.
Whereas, on receipt of the reply to Show Cause Notice, the accused requested for opportunity for personal hearing. The Authority/ Member (Admn/HR) provided an opportunity of personal hearing to the accused on July 26, 2022.

Accordingly, the Authority/ Member (Admn/HR), FBR after having considered all aspects of the case i.e. inquiry report, reply to the Show Cause Notice, written and verbal submission made by accused/Departmental Representative during the personal hearing and relevant case record, has found that the accused being the seizing officer in the instant case has not only mis-reported the place of recovery of goods but deliberately concealed the detention of vehicles carrying smuggled goods.
He has also misstated the date of detention i.e. November 19, 2021 instead of November 17, 2021 for ulterior motives. The accused officer failed to submit separate examination reports in respect of each intercepted vehicle. The accused further appears to be guilty of directly bargaining for illegal gratification with the complainant/owner of the goods.

Hence, the charges of “inefficiency”, “misconduct” and “corruption” under Rule-3(a),(b)&(c) of the Civil Servants (Efficiency & Discipline) Rules, 2020 stand established against the accused. The Authority, therefore, has agreed with the findings and recommendations of the Inquiry Officer and imposed major penalty of “Removal from Service” upon Imran Fareed, Inspector (BS-16), under Rule-4(3)(d) of the Civil Servants (Efficiency & Discipline) Rules, 2020 with immediate effect.
The officer, shall have the right to appeal before the Appellate Authority as admissible under the Civil Servants (Appeal) Rules, 1977 read with Rule-19 of the Civil Servants (Efficiency & Discipline) Rules, 2020.

FBR imposes major penalty on Customs appraising officer
ISLAMABAD: The Federal Board of Revenue (FBR) has imposed major penalty of ‘compulsory retirement from service’ upon a customs appraising officer on the charges of misconduct and inefficiency.
According to a notification issued on Monday, the FBR said that disciplinary proceedings under Government Servants (Efficiency & Discipline) Rules, 1973 were initiated against Nihal Kazim, Appraising Officer (BS-16), Collectorate of Customs Appraisement (West), Karachi through a charge sheet issued on October 29, 2019.

Ms. Rabel Khokhar, Assistant Collector, the then Collectorate of Customs Appraisement, Customs House, Karachi was appointed as Inquiry Officer to conduct inquiry on account of various acts of omission and commission committed by the accused officer constituting “Inefficiency” and “Misconduct”.
The Inquiry Officer submitted Inquiry Report dated January 29, 2020, according to which the charges of “Inefficiency” and “Misconduct” were established against the accused officer.
A Show Cause Notice dated July 17, 2020 was issued to the accused officer and in response, he submitted his defence reply and also appeared for personal hearing before the Collector/Authorized Officer on August 11, 2020.

After considering the inquiry report, reply of the accused to the Show Cause Notice and his oral submissions during the personal hearing with the Authorized Officer, the accused officer has been found guilty of “Inefficiency” and “Misconduct”.
The Authorized Officer/ Collector recommended imposition of major penalty upon the accused. The Member (Admn/HR) / Authority before deciding the case afforded an opportunity of personal hearing to the accused on zoom/ telephone phone due to his illness on June 23, 2022.
The Member (Admn), FBR being “Authority” in this case, after having carefully considered case record, inquiry report, verbal submissions of the accused during hearing and recommendations of the Authorized Officer/ Collector has found no solid evidence and merits in the stance of the accused for his prolonged un-authorized absence from duty for three years.

Accordingly, the Member (Admn/ HR) / Authority has observed that the charges of “Inefficiency” and “misconduct” under Rule-3(a)&(b) of Civil Servants (E&D) Rules, 1973 stand established against the accused.
The Authority has, therefore, imposed major penalty of “Compulsory Retirement from Service” upon Nihal Kazim, Appraising Officer (BS-16), Collectorate of Customs Appraisement (West), Karachi under Rule 4(1)(b)(ii) of the Civil Servants (E&D) Rules, 1973. Moreover, his period of absence from duty i.e. November 20, 2016 till date is treated as Extra Ordinary Leave (EOL) and the excess amount drawn as pay and allowances is to be recovered from pensionary benefits.

KARACHI: Federal Board of Revenue (FBR) has sacked a Customs appraising officer (BS-16) on charges of misconduct and inefficiency.
According to a notification issued on Tuesday, the FBR said disciplinary proceedings were initiated against Arjad Abbas Khosa, Appraising Officer (BS-16), Collectorate of Customs, Islamabad under the Civil Servants (Efficiency & Discipline) Rules, 2020 on account of acts of omission and commission constituting ‘Inefficiency’ and ‘Misconduct’.

Ms. Kaukab Farooq, Additional Collector (BS-19), Collectorate of Customs, Islamabad was appointed as Inquiry Officer on January 06, 2022, who conducted inquiry under the Civil Servants (Efficiency & discipline) Rules, 2020 and submitted inquiry report to the Board on March 04, 2022 with the findings that the Allegation No. (i), (ii) and (iii) as mentioned in Order of Inquiry stand proved against the accused Appraising Officer.
The Inquiry Officer has concluded that the charges of “inefficiency” and “Misconduct” against the accused officer stand established.

On the basis of Inquiry Report, Show Cause Notice was served on March 18, 2022 upon Arjad Abbas Khosa, Appraising Officer (BS-16), Collectorate of Customs, Islamabad. The Collectorate served show cause notice to the accused by displaying on notice board, on his personal email address and through courier on his given residential addresses.
The accused failed to submit his defence reply to the show cause notice nor made any request for personal hearing during the stipulated time period. As no defence reply to show cause notice has been submitted before the Member
(Admn/HR)/Authority by the accused, the authority, by considering the available case record and inquiry report has observed that the accused has been absconding from duty w.e.f. April 16, 2021 without any intimation. Therefore, the charges leveled vide Order of Inquiry dated January 06, 2022 stand established.

Accordingly, the Member (Admn/ HR) / Authority has decided that the charges of “Inefficiency” and “misconduct” under Rule 3(a) and (b) of Civil Servants (E&D) Rules, 2020 stand established against the accused.
The Authority has, therefore, imposed major penalty of “Dismissal from Service” upon Arjad Abbas Khosa, Appraising Officer (BS-16), Collectorate of Customs, Islamabad under Rule-4(3)(e) of the Civil Servants (E&D) Rules, 2020.

ISLAMABAD: Federal Board of Revenue (FBR) has awarded major penalty of ‘removal from service’ upon a chemical examiner of Pakistan Customs Service (PCS) on the charges of misconduct and inefficiency.
According to details received on Monday, disciplinary proceedings were initiated against Tahir Jamal, Deputy Assistant Chemical Examiner (BS-16), Collectorate of Customs Appraisement-West, Karachi under the Civil Servants (Efficiency & Discipline) Rules, 2020.

Saad Atta Rabbani, Additional Collector (BS-19), Collectorate of Customs Appraisement (West), Karachi was appointed as Inquiry Officer vide Order of Inquiry dated August 04, 2021 who conducted inquiry under the Civil Servants (Efficiency & discipline) Rules, 2020 and submitted inquiry report to the FBR on January 05, 2022 with the findings and conclusion that the charges of “Inefficiency” and “Misconduct” stand fully established against the accused officer.
On the basis of Inquiry Report, a Show Cause Notice was issued on March 31, 2022 to Tahir Jamal, Deputy Assistant Chemical Examiner (BS-16), Collectorate of Customs Appraisement (West), Karachi.

He submitted reply to the Show Cause Notice, which was received in the Board on April 15, 2022, wherein he stated that the Order of Inquiry dated August 04, 2021 is illegal and requires to be withdrawn.
He further stated that he has challenged the Order of Inquiry by filing an appeal before the Federal Service Tribunal (FST). He also requested for personal hearing enabling him to explain his case in person as well.
The Member (Admn/HR) / Authority afforded an opportunity of personal hearing to the accused on May 23, 2022.
The Member (Admn/ HR) / Authority having carefully considered the record of the case, the Inquiry Report, reply to the Show Cause Notice and the submissions made by the accused during the personal hearing, has found no solid evidence and merits in the stance of the accused for submitting wrong/misleading laboratory test reports and remaining away from office w.e.f. August 07, 2018 till date.

President Alvi retains major penalty on NAB official
ISLAMABAD: The President of Pakistan, Dr. Arif Alvi, has rejected the appeal of a NAB official to set aside the major penalty awarded to him over unlawful communication of official information for benefits of corruption.
He also directed NAB to proceed against other officers involved in such cases and if found guilty punish them for doing corruption within the very institution that was responsible for controlling corruption.

Noman Iqbal, Assistant Private Secretary (BS-16) had been awarded the major penalty of “reduction to a lower post for a period of five years” after it was proven that he copied and shared official information with unauthorized individuals.
National Accountability Bureau (NAB), Karachi had conducted a fact-finding inquiry, based on a source report, under which confidential record was found in the mobile phone of appellant, which he was otherwise not authorized to hold.

NAB had recommended initiating disciplinary proceedings against Iqbal. Initially, the matter was probed by Chairman Inspection and Monitoring Team, NAB (HQ), which revealed that Iqbal was involved in unlawful communication of official information inside and outside NAB in connivance with two other officials of NAB, Karachi.
An inquiry committee was also constituted to probe into the matter that found the appellant guilty on charges of “misconduct” and “disclosure of official secrets”.
A forensic analysis of appellant’s phone also found chats and documents which proved that he had copied and shared information with unauthorized individuals. Afterwards, Iqbal was awarded the penalty of reduction to a lower post for five years and two other officers involved were also penalized.

Iqbal then submitted an appeal to the President, being the Appellate Authority, under NAB Employees Services Rules (TCS-2002) to set aside the major penalty.
Chairman NAB through a summary, circulated through the Ministry of Law and Justice and endorsed by the Prime Minister, requested that the appeal of Iqbal may be rejected. President Dr Arif Alvi upheld the original decision on the grounds that Iqbal had not provided any cogent reason or additional justification to recall the earlier decision of major penalty.

He emphasized that for such individuals this penalty does not do justice and wished that the punishment should have been harsher. “I direct NAB to complete the investigation against other officers involved and if found guilty punish them for the wrong done to the country and tarnishing its image,” the President noted while rejecting the appeal.

ISLAMABAD: The Federal Board of Revenue (FBR) has imposed major penalty of ‘dismissal from service’ upon an officer of Pakistan Customs on the charges of corruption, misconduct and inefficiency.
The FBR in an office order issued on Tuesday stated that disciplinary proceedings were initiated against Mansab Shah, Inspector (BS-16) posted in Collectorate of Customs (Enforcement), Lahore in September 2020 on account of ‘Inefficiency, Misconduct & Corruption’.

Muteen Alam, Additional Collector (PCS/BS-19), Collectorate of Customs (Enforcement), Lahore was appointed as Inquiry Officer to conduct inquiry into the case on account of acts of omission and commission as detailed in the Charge Sheet / Statement of Allegations.
The Inquiry Officer submitted the inquiry report, according to which the charges of “Inefficiency, Misconduct & Corruption” were established against the accused officer.
Accordingly, the Collector, Collectorate of Customs (Enforcement), Lahore / Authorized Officer served Show Cause Notice dated February 15, 2021 upon the accused.

Upon receipt of reply to the Show Cause Notice, the accused was granted personal hearings on February 24, 2021 and March 24, 2021 to show cause in his defence.
The authorized officer, after considering the inquiry report, reply to Show Cause Notice and oral submissions made during the personal hearings, found the accused officer guilty of “Inefficiency, Misconduct & Corruption” and recommended to the Authority i.e. Member (Administration/Human Resource), FBR to impose major penalty of “Reduction to the lower post of Data Entry Operator” upon the accused officer as prescribed under Rule-4(1)(b)(iv) of the Government Servants (Efficiency & Discipline) Rules, 1973.

The Member (Admn/HR)/Authority afforded an opportunity of personal hearing to the accused to defend the case in person on June 21, 2021. However, the accused failed to appear for hearing on the scheduled date and time and Final Show Cause Notice dated August 13, 2021 was served upon the accused by the Member (Admn/HR)/ Authority and he submitted written reply to the Show Cause Notice dated August 25, 2021.
The Member (Admn/HR) / Authority after going through the facts and record of the case, and having considered all aspects of the case submitted before him, did not agree with the recommendations of the Authorized Officer/ Collector regarding imposition of major penalty of “Reduction to lower post of Data Entry Operator” upon the accused and acting in the capacity as Authority, in exercise of powers conferred under Rule 5(1)(iv) of Government Servants (E&D) Rules, 1973 has imposed major penalty of “Dismissal from Service” upon Mansab Shah, Inspector (BS-16), Collectorate of Customs Enforcement, Lahore under Rule-4(1)(b)(iv) of the Government Servants (Efficiency & Discipline) Rules, 1973.

Akbar Jan, the then Deputy Collector (PCS/BS-18), Model Customs Collectorate (Enforcement & Compliance), Quetta was appointed as Inquiry Officer to conduct inquiry into the case on account of acts of omission and commission as detailed in the Charge Sheet / Statement of Allegations.
The inquiry officer submitted the report dated October 09, 2020. According to the report the charges of inefficiency and misconduct were established against the accused officer.

Accordingly, the Collector, Collectorate of Customs (Enforcement), Quetta / Authorized Officer served Show Cause Notice dated November 26, 2020 upon the accused.
Upon receipt of reply to the Show Cause Notice, the accused was granted personal hearings on December 14, 2020, December 22, 2020 and December 31, 2020 to show cause in his defence.

The authorized officer, after considering the inquiry report, reply to Show Cause Notice and oral submissions made during the personal hearings, found the accused guilty of “Inefficiency” & “Misconduct” under Rule-3(a)&(b) of the Government Servants (Efficiency & Discipline) Rules, 1973 and recommended to the Authority i.e Member (Administration/Human Resource), FBR to impose major penalty of “Dismissal from Service” upon the accused officer as prescribed under Rule-4(1)(b)(iv) of the Government Servants (Efficiency & Discipline) Rules, 1973.
