FBR redefines Tier-1 retailers for integration

The Federal Board of Revenue (FBR) has redefined Tier-1 retailers, making it mandatory for them to integrate sales data on a real-time basis.

The updated Sales Tax Act, 1990, issued by the FBR and effective up to June 30, 2021, incorporates amendments introduced through the Finance Act, 2021. The redefinition of Tier-1 retailers comes as part of broader efforts to modernize tax administration and streamline the reporting of sales transactions.

Mandatory Point of Sale (POS) Integration:

Under the revised definition, Tier-1 retailers are now required to install Point of Sale (POS) systems for the real-time sharing of sales details. This move is aimed at creating a seamless and automated process for reporting sales transactions, providing the FBR with accurate and up-to-date information for tax assessment purposes.

Revised Definition of Tier-1 Retailer:

The redefined Tier-1 retailer now includes businesses falling into one or more of the following categories:

(a) Retailer in a National or International Chain: A retailer operating as part of a national or international chain of stores falls under the Tier-1 category. This recognizes the impact and influence of retailers contributing to established chains with a widespread presence.

(b) Retailer in Air-Conditioned Shopping Malls: Tier-1 retailers encompass those operating in air-conditioned shopping malls, plazas, or centers, excluding kiosks. This inclusion acknowledges the operational environment and scale of such retail spaces.

(c) Retailers with High Electricity Consumption: Retailers whose cumulative electricity bill during the immediately preceding twelve consecutive months exceeds Rupees twelve hundred thousand are considered Tier-1. This criterion aims to identify retailers with higher levels of energy consumption, signifying larger-scale operations.

(d) Wholesaler-cum-Retailer: Wholesaler-cum-retailers engaged in bulk import and supply of consumer goods on a wholesale basis to retailers and on a retail basis to consumers fall within the Tier-1 definition. This recognizes the dual role and significant impact of businesses operating in both wholesale and retail capacities.

(e) Retailers with Specific Shop Size: Retailers with shops measuring one thousand square feet in area or more, or two thousand square feet in the case of furniture retailers, are categorized as Tier-1. This acknowledges the scale and capacity of these retail establishments.

(f) Retailers Accepting Digital Payments: Retailers who have acquired Point of Sale systems for accepting payments through debit or credit cards from banking companies or other authorized digital payment service providers fall under Tier-1. This encourages the adoption of digital payment methods, aligning with global trends in financial transactions.

(h) Any Other Person Prescribed by the Board: The Tier-1 definition includes a provision for the FBR to prescribe any other person or class of persons as Tier-1 retailers. This flexibility allows for the adaptation of the definition to evolving business models and emerging trends in the retail sector.
